Dear Warder
Forgive my replying again instead of Bertie — we have been consulting a lawyer here and are now hurrying to get off several letters at once, and he is writing the others.
Bertie had already replied to your letter saying that he had no thought of withdrawing (letter not mailed).b Now the situation is changed by the decision of the supreme court. Ifc the Board of H. E. intends to appeal, Bertie will brief counsel to represent his personal interests. But if the Board does not intend to appeal there is apparentlyd nothing we can do. In view of the message you transmitted about the financial difficulties, perhaps they wait appeal in a case which seems almost hopeless — as far as we can judge.
Is it possible for you to continue your good offices by sounding your anonymous friend as to the Board’s probable action? If so please telegraph. Bertie is writing to Roger Baldwin of the Civil Liberties — could you also get in touch with him and discuss what action is possible for Bertie. We will fight the thing as far as we have any chance.
